Case Highlights

Protecting water rights (and a business):  Scott served as lead counsel in a water rights case where a client was faced with a temporary restraining order that would have prevented the use of water for irrigation.  The order threatened to destroy the client’s business.  Scott immediately obtained an emergency hearing, worked through the night with his litigation team and the client, and appeared the next morning before the Court with a polished presentation that convinced the judge to lift his order.  Scott was ultimately successful in impeaching the other side’s expert witness and obtaining a complete dismissal of the case. 

Implementing bottom-line strategies: When a general contractor refused to complete a large construction project, the owner faced a stalled project, multiple lawsuits, high carrying costs, and threatened default from financial backers.  The owner retained Scott as lead counsel.  Scott developed and implemented a strategy involving simultaneous litigation and intense negotiations between the owner, general contractor, subcontractors, bonding companies and material suppliers.  The dual strategies ultimately resulted in completion of the project on schedule and on budget, along with a complete dismissal of all litigation.

Relentless pursuit of client rights:  Scott was retained as lead counsel by a client who had loaned several million dollars on a mining venture.  The debtor refused to pay and transferred assets to several trusts, including international trusts.  Scott pursued claims and assets in several state and federal court actions and in bankruptcy proceedings.  Scott recovered all of the client’s money, including interest and attorneys’ fees.
